These Terms of Use outline the relationship between you, the User, and the ArchCache platform, the provider of architectural information and graphical-related content.
By using this website, you agree that these Terms are a fundamental part of any contractual agreement with us and accept the following provisions and legal information related to our offerings, as well as any third-party services and products provided by us in this context.
Certain digital services are subject to specific Terms and Use, which are explicitly referenced in the relevant commercial product quotation. In the case of any discrepancy between these Terms and Conditions and the specific Terms and Conditions, the specific Terms and Conditions shall override these Terms of Use.
1. Intellectual Property and Copyright
All trademarks, names, logos, images, photographs, graphics, designs, content, texts (including advertisements), layouts, software, and other materials featured in our digital services are owned by ArchCache platforms or licensed third parties. The User is not permitted to copy (in whole or in part), distribute (via electronic means or otherwise), alter, link to, or utilize any such material for public or commercial purposes without obtaining our prior written authorization
2. User Contents and Conducts
By uploading individual portfolios and comics, you retain ownership of the content you submit. However, by submitting content on the ArchCache platform, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the site. You also agree not to upload, post, or transmit any content that violates applicable laws or infringes upon the rights of others, including intellectual property rights, privacy rights, or publicity rights
Users must use the ArchCache platform responsibly and not misuse them. You must not use the ArchCache platform without an agreement or attempt to resell the contents therein. Do not allow others to use your account information or access the platform in ways that violate our terms. Avoid actions like constructing databases with the Content Files, accessing the Services and Software through unauthorized means, circumventing access restrictions, or engaging in behavior that violates Intellectual Property Rights. Additionally, do not generate or share harmful, unlawful, or inappropriate content, impersonate others, disrupt the Services, engage in fraudulent activities, or use data mining methods. Also, creating fake accounts or violating our terms of use is highly prohibited.
3. User Account and Subscription
Your account on our platform is your responsibility, whether you are a Personal or Business User. Only registered users may download our sensitive projects and products. By signing up, you commit to providing accurate, complete, and current information about yourself or your business, and to update this information promptly as changes occur. Creating an account with false or misleading information is prohibited. You are fully responsible for all activities that occur under your account and for safeguarding your password. Ensuring the security of your ArchCache account is your sole responsibility, and we will not be liable for losses due to compromised login credentials. Regularly accessing your account is essential to prevent deletion or termination, and we will notify you before taking any action due to inactivity.You have the option to cancel your subscription and terminate your use of our services at any time.
We offer different subscription plans, including basic, standard, and premium plans, each with varying features and pricing. By subscribing to a plan, you agree to pay the applicable fees and abide by the terms and conditions associated with that plan. Subscriptions may be set to automatically renew at the end of each billing period unless canceled by the user. You may cancel your subscription at any time by following the instructions provided on the Site.
However, canceling or terminating your account does not release you from any outstanding fees associated with your subscription, including early cancellation fees. We reserve the right to immediately terminate or suspend your access to our services under certain circumstances. These include breaches of the Terms, failure to pay fees, abusive behavior towards our personnel, or violation of applicable laws. In case of termination for reasons other than cause, we will make reasonable efforts to notify you in advance and provide instructions to retrieve your content. Refunds for prepaid, unused fees may be provided if there are valid and tangible reasons that warrant the non-usage of the account.
Upon termination, access to some or all of the services may cease without prior notice. However, certain provisions, such as indemnification obligations, warranty disclaimers, limitations of liabilities, and dispute resolution provisions, will continue to apply. If you believe your ArchCache account has been deactivated erroneously, you can contact our support with evidence.
4. Limitation of Liability
ArchCache aims to provide high-quality, accurate, and available digital services, but temporary issues and downtime (like service interruptions, troubleshooting, and maintenance) may occur. Users use ArchCache products at their own risk, and no warranties are given for these products and software. ArchCache is not liable for services provided by third parties, including links to third-party content and services. ArchCache is not responsible for the legality, accuracy, completeness, or availability of such external content.
Additionally, ArchCache is not liable for damage caused by viruses or other harmful software, such as malware or spyware. The liability of ArchCache (including that of its affiliates, employees, representatives, and agents) is limited to intentional or grossly negligent breaches of duty that are proven. To the extent allowed by law, our liability is limited to the amount the User paid for the relevant products. ArchCache is not liable for indirect damages or lost profits.
5. Sharing Contents and Comments
When using the ArchCache platform, you may have the option to share your content with others or make it public. This sharing entails various actions like emailing, posting, or uploading content. It'simportant to understand that once shared, others may use, modify, or re-share your content. You are responsible for determining the access limitations on your content and ensuring that appropriate access levels are applied. Comments submitted through our platform may be visible to other users and can be deleted by you, other users or us. If you delete content, we will cease its public availability within a reasonable time frame, though some copies may be retained in routine backups. If your content is removed for violating the Terms, we'll make efforts to notify you.

6. Fees and Payment
Please carefully review these Fees and Payment Terms before making any payments on the ArchCache platform. ArchCache is not liable for any applicable taxes or third-party fees, such as VAT, credit card fees, foreign exchange fees, mobile carrier fees, and data plan charges. For any questions regarding fees, you should contact your financial institution.
By making a payment on ArchCache, you authorize us or our authorized vendor(s) to store your payment method and use it for subscriptions and other payment plans associated with your use of our platform. To ensure uninterrupted service, we may engage in programs supported by your card provider to update your payment information. You authorize us or our authorized vendor(s) to continue billing and charging your account for any amounts due using the updated information we obtain.
By proceeding with payments on the ArchCache platform, you acknowledge and agree, on behalf of yourself, your employer, or any other applicable entity, to be bound by these Payment Terms.
7. Other Provisions
If ArchCache does not enforce its rights under these Terms of Use, it does not mean that ArchCache waives those rights. If any part of these Terms of Use is found to be invalid or unenforceable, the rest of the terms will still be valid. The invalid part will be replaced by a new provision that closely matches the economic and legal intent of the original.
ArchCache reserves the right to change these Terms of Use at any time at its discretion. Any changes will be posted on the ArchCache website promptly. It is the User's responsibility to stay updated on the current Terms of Use.
8. Law and Jurisdiction
These Terms of Use are governed by and interpreted by the laws of Nigeria. Any disputes regarding these terms will be exclusively handled by the courts of Nigeria. We are committed to protecting your interests and privacy following the NITDA Act, 2007. All communications and online transactions conducted on our platform will be handled with the utmost respect for your privacy. Rest assured that any personal data transactions between parties will be safeguarded under the NDPR, 2019, the Cybercrime Act, 2015, and the African Union Convention on Cyber Security and Personal Data Protection.
